Company: Volcano Ohana LLC and its representatives, employees, and contractors, with a mailing address: PO Box 464, 17-588 Volcano Rd, Kurtistown, HI 96760 (“Company”).

II. LIABILITY EVENT: Under the terms of this Agreement and sufficiency of which is hereby acknowledged, the Releasor does hereby release and forever discharge the Company including their agents, employees, contractors, successors and assigns, and their respective heirs, personal representatives, affiliates, successors, and any and all persons, firms or corporations liable or who might be claimed to be liable, whether or not herein named, none of whom admit any liability to the undersigned, but all expressly denying liability, from any and all claims, demands, damages, actions, causes of action or suits of any kind or nature whatsoever, which now have or may hereafter have, arising out of or in any way relating to any and all injuries and damages of any and every kind, to both person and property, and also any and all injuries and damages that may develop in the future, as a result of or in any way relating to the Liability Event.(Required)

III. CRUISE PORT PICK UP/DROP OFF: Transportation will be provided for the Releasor by the Company, from Hilo Cruise Port to the designated meeting spot for the tour. After the tour has concluded, transportation will be provided for the Releasor back to Hilo Cruise Port. The Releasor will not hold the Company including their agents, employees, contractors, successors and assigns, and their respective heirs, firms or corporations liable or who might be claimed to be liable, whether or not herein named, none of whom admit any liability to the undersigned for any liability or events caused during transportation.(Required)

IV. SAFETY PROCEDURE VIDEO: The safety procedure video has been played in the vehicle while the Releasor was being transported to meeting site. The Releasor watched and understands all safety procedures on how to operate a Fat Tire E-Bike.(Required)

V. RELEASE OF MEDIA USAGE: Any photos or videos that are taken are for the sole use of the Company. The Company is allowed to use photos or videos that the Releasor may be in for the Company’s sole marketing purposes with no obligation for monetary payment to Releasor.(Required)

VI. RESPONSIBLE FOR DAMAGES: In the event the Releasor causes any damage to property provided by the Company, it will be the responsibility of the Releasor to cover the costs of repair or full costs of replacement for items damaged under all circumstances, intentional or accidental.(Required)

VII. CONDITION TO PARTICIPATE: Each participant in activities led by the Company must be deemed competent to participate in the activity by the company representative/activity leader. Competency includes, but is not limited to, the mental and/or physical ability to operate equipment necessary for the activity. No participant will be allowed to participate in the activity if they are reasonably suspected by a company representative/activity leader of being under the influence of any drug, alcohol, or medication. No participant will be allowed to participate in the activity if they are deemed unable to physically operate the related equipment. Should the participant be deemed physically and/or mentally incompetent to participate in the chosen activity the Company will not refund any fee paid for the activity.(Required)

VIII. HOLD HARMLESS: If the Releasors actions cause damage or injury to any other person or property, Releasor agrees to hold the Company harmless from any liability and agrees to indemnify them from all costs, fees and/or judgments resulting from such claims or lawsuits relating to Releasors actions.
